Welcome to FOHbot. These Terms of Service ("Terms") govern your access to and use of the FOHbot website, applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

FOHbot provides an AI-powered guest assistant service for restaurants and hospitality businesses. Our Service includes:

• An AI chatbot that answers guest questions about your restaurant
• Menu digitization and management tools
• QR code generation and print materials
• Guest feedback collection and review management
• Analytics and insights dashboard
• Reservation and event management features

3. Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

4. Subscription and Payment

4.1 Pricing

FOHbot offers subscription plans as described on our pricing page. Current pricing includes a one-time onboarding fee and recurring monthly or annual subscription fees. Prices are subject to change with notice.

4.2 Payment Terms

By subscribing to a paid plan, you authorize us to charge your payment method for the applicable fees. Subscription fees are billed in advance on a monthly or annual basis. All payments are non-refundable except as expressly stated in these Terms or required by law.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. No refunds will be provided for partial billing periods.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service for any fraudulent or deceptive purposes
• Collect or harvest user information without consent
• Send spam or unsolicited communications through the Service
• Misrepresent your identity or affiliation with any person or entity

6. Your Content

You retain ownership of all content you submit to the Service, including restaurant information, menus, images, and policies ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing the Service.

You represent and warrant that you have all necessary rights to Your Content and that Your Content does not violate any third-party rights or applicable laws.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by FOHbot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

8. AI-Generated Content

Our Service uses artificial intelligence to generate responses to guest inquiries. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. You are responsible for reviewing and ensuring the accuracy of information provided through your FOHbot assistant. We recommend regularly updating your restaurant information to maintain accuracy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOHBOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless FOHbot and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, Your Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sarasota County, Florida.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
